The crash happened about 2:20 a.m. on Sunday at Grand and McFadden avenues. Santa Ana police reported that Herrera was traveling northbound on Grand in an Acura TL that rear-ended a Scion XD. The vehicles continued across the intersection before coming to a stop in the southbound lanes of Grand north of the intersection.

Jorge Davalos Carrillo, 39, of Garden Grove, who was a passenger in the Scion, was pronounced dead at the scene, said Santa Ana police Cpl. Anthony Bertagna. The Scion’s driver was taken an area hospital with injuries of unknown severity.

Carrillo, who had a prior DUI conviction, was “out with friends and called for a designated driver, so a friend picked him up to drive him home and he got killed by a suspected drunk driver,” Bertagna said.
